Acceptable Use Policy
1. Purpose
The MedStock Acceptable Use Policy ("AUP") defines the standards of conduct required of all authorized Retailers and Wholesalers accessing the MedStock inventory financing platform. Compliance with this AUP is a condition of your ongoing access to our credit facilities and digital marketplace.
2. Prohibited Financial Activities
You agree not to use MedStock's financing tools, payment gateways, or platform to:
- Conduct or facilitate money laundering, terrorist financing, or sanctions evasion.
- Engage in "round-tripping" or circular trades designed artificially to inflate purchasing limits or credit scores between colluding pharmacies and suppliers.
- Use disbursements from MedStock credit lines for purposes other than the procurement of genuine pharmaceutical and medical inventory.
- Provide false, forged, or manipulated financial statements, PPB licenses, or identity documents during the KYB/KYC process.
3. Prohibited Platform Misuse
When accessing the MedStock digital application, you must not:
- Attempt to gain unauthorized access to other Retailers' or Wholesalers' accounts, sensitive pricing data, or credit limits.
- Use automated scripts, bots, scrapers, or unauthorized APIs to extract bulk inventory data or pricing from the platform.
- Upload or distribute malicious code, viruses, or ransomware intended to harm MedStock's infrastructure.
- Circumvent or attempt to bypass security layers, rate limits, or multi-factor authentication controls.
4. Regulatory Compliance & AML
MedStock operates strictly within the confines of Kenyan law, governed by the Central Bank of Kenya (CBK) guidelines on digital credit. All activities suspected to violate Anti-Money Laundering (AML) statutes or the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA) will be immediately reported to the Financial Reporting Centre (FRC).
5. Enforcement & Penalties
Violation of this Acceptable Use Policy constitutes a material breach of the Terms of Service. MedStock reserves the right, at its sole discretion, to:
- Immediately suspend or permanently terminate your account without notice.
- Call in any outstanding financed balances for immediate repayment.
- Report the entity and its directors to the relevant authorities, credit reference bureaus (CRBs), and professional boards (e.g., PPB).
- Pursue legal action to recover damages arising from the breach.
6. Restricted and Prohibited Product Transactions
Users must not list, finance, purchase, or distribute counterfeit medicines, expired products, unregistered pharmaceuticals, recalled stock, or products that require regulatory approvals not held by the transacting entity.
- All listed products must meet PPB and applicable Kenyan legal requirements.
- Product traceability records must be maintained and presented upon lawful request.
- MedStock may suspend any listing or transaction pending authenticity and compliance review.
7. Reporting Violations and Investigation Cooperation
Users are expected to promptly report suspected fraud, account compromise, suspicious disbursement activity, or suspected unlawful product circulation through official support channels.
Where an investigation is opened, affected users must provide accurate records and cooperate with reasonable verification requests. Failure to cooperate may result in temporary account restrictions while review is ongoing.
